Kylie Minogue's homeware brand has lost its legal battle against Caprice Bourret after accusing her company of copying bed linen designs. 

British textile company Ashley Wilde Group, which runs the singer's At Home range, has been told be a judge that an appeal at the High Court had 'no real prospect of success'. 

The ruling concludes the two-year legal dispute which was bought about by accusations of plagiarism.

Kylie's parent company originally alleged that the brand known as By Caprice Home, created by the Dancing On Ice star, had copied several of its signature patterns such as 'scalloped-shaped pleats'.

Caprice, 48, was among those who gave evidence during the proceedings and was later praised by the judge for her candid testimony.

A decision had already been made by a judge which concluded that the features on the duvet covers in question had been used for centuries and so By Caprice Home had not breached any form of copyright.

Ashley Wilde Group had submitted an application to appeal the decision - but this has now been refused as Lord Justice Floyd blocked the motion on the grounds that: 'The judge made no error in her previous approach.'

This comes after the Australian icon, 51, won a previous court battle against Kylie Jenner during a trademark dispute in 2017.

Kylie successfully blocked the star, 21, from trademarking their shared name and she has now thanked the cosmetics guru.

Speaking to Paper in June, Minogue, who has long struggled to top the charts in America, explained how Jenner has introduced her to a new audience there.

'Actually, when I was young there was no one called Kylie, so to explain I would have to spell it out, especially in America,' Minogue told the publication.

'Thanks to Kylie Jenner, they do know the name Kylie. So, winning.'

Discussing the trademark war, the Golden singer then laughed at the huge coverage it attracted: 'It's hilarious that it caused such a kerfuffle. 

'I think she has done amazingly well, but I think it's just important that people know that there is room for more than one Kylie.'

Jenner, who is a half-sister to Kim Kardashian West, applied to trademark the name 'Kylie', for her clothing and cosmetic businesses, in the U.S. in April 2014.

In response, Minogue's representatives sent the U.S. Patent and Trademark Office a long list of reasons why the trademark should not be granted.

Describing Jenner as 'a secondary reality television personality', the letter argued that, in contrast, Minogue was an 'internationally-renowned performing artist, humanitarian and breast cancer activist known worldwide simply as 'Kylie'.'

In February 2017, the Patent office furniture hauling away rejected Jenner's application.

Prior to the legal battle, Minogue had released fragrances, furniture and clothes in the U.S., all baring her trademark name Kylie.

Following the triumph, Minogue has released her own cosmetics range, which appears on her official Step Back In Time website and features six items including a lip gloss, lip oil, cheek glitter and metallic eye shadow.

The products are priced between $22 AUD and $28 AUD, and are named after some of Kylie's most famous songs including Wow, Raining Glitter and Golden. 

While Minogue's range contains several products that are similar to those sold by Kylie Jenner, the branding is very different.

The Australian singer's makeup branding appears to be inspired by pool parties, tropical locations and brightly-coloured desserts.

In contrast, Jenner's products feature a more minimalistic branding aesthetic.
